New BOP Regulations on FSA Earned Time Credits

On January 13, 2022, the Federal Bureau of Prisons published new regulations concerning implementation of the First Step Act’s Earned Time Credits. A many know, as a result of COVID-19, many of the “Evidence Based Recidivism Reduction” programs or “Productive Activities”, for which inmates can earn time credits for additional time in a Halfway House, Home Confinement or Supervised Release, were slow to be implemented. However, the Bureau as decided to grant retroactive earned time credits back to January 2, 2018, the date the First Step Act was implemented. As a result, recently many inmates were awarded these credits and released to a halfway House, Home Confinement or Supervised Release. The First Step Act excludes many inmates form receiving earned time credits based on their current crime of conviction.
